Terms and conditions of use

The Sime Motors companies in Singapore are committed to ensuring that your personal data is protected. The purpose of this document is to explain how we collect information about you, the procedures that we have in place to safeguard your privacy and how you can instruct us if you prefer to limit the use of that information.

Privacy policy

The Sime Motors companies in Singapore including Performance Premium Selection Limited will collect and use your personal data which we obtain directly from you, for example from the vehicle sales or purchase agreements, repair order, vehicle rental agreements and/or contracts and related forms signed by you, from third parties, such as credit reference agencies or our service providers, or information we obtain as a result of our relationship with you, for any of the following purposes, where applicable:

for verifying your identity;
for registration of the vehicle(s) stated in the vehicle sale agreement(s) and/or other contracts entered into with you, to register ownership of the vehicle(s) with the relevant transportation authorities, including but not limited to Land Transport Authority;
to comply with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
for the provision of vehicle leasing, rental or chauffeur driven services as stated in the respective contracts entered into with you for such services;
to share your information with the vehicle manufacturer(s), its/their related corporations and contractors whether within or outside Singapore and/or insurance companies, which will provide the necessary warranties and/or extended warranties (if any) for the vehicle(s);
to share your information with financial institutions and motor vehicle insurers, on your behalf, in order that you may obtain financing for the purchase of the vehicle(s) and the motor insurance on the vehicle(s), respectively and, where applicable, to obtain the loan amounts outstanding from financial institutions, on your behalf, in order to assist you in effecting your motor vehicle loan redemptions;
to share and update our after-sales service records. The relevant information is then used by us, our appointed after-sales service dealers, our agents and subcontractors and/or the vehicle manufacturer(s) and/or its related corporations whether within or outside Singapore to provide the relevant after-sales service and/or to repair the vehicle(s) as well as to communicate with you on any matter relating to the provision of the services in general including to notify you by any means, including by short message services (“SMS”), messaging applications (including WhatsApp and Telegram), phone call or electronic mail, of the next/subsequent date/ mileage for routine service for the vehicle(s);
for research, audit and analysis purposes so that we can monitor and improve the services we provide, for administrative purposes and geographical and statistical analysis;
for marketing, promotional and/or event purposes, and/or to inform you of any new products or services provided by the Sime Motors companies in Singapore by any means (including through SMS, messaging applications (including WhatsApp and Telegram), phone call, electronic mail, fax, magazines, or brochures);
or the administration, performance and enforcement of any agreements and/or contracts entered into with us, and/or to perform obligations in the course of or in connection with the provision of goods and/or services to you; and

We will also disclose your information (whether within or outside Singapore):-

to our service providers, for example, providers of web hosting or maintenance services, for the purpose of supplying us with the inter connected servers and/or web site links with the relevant authorities;

to our customer service agencies for research and analysis purposes so that we can monitor and improve the services we provide, for administrative purposes and geographical and statistical analysis;

to our service providers and/or the vehicle manufacturer(s), its/their related corporations and contractors for marketing, promotional and/or event purposes, and/or to inform you of and send to you by any means (including through SMS, messaging applications (including WhatsApp and Telegram) phone call, electronic mail, fax, magazines or brochures) any new products or services that is provided by the vehicle manufacturer(s) or its/their related corporations and/or the Sime Motors companies;

to the vehicle manufacturer(s), its/their related corporations and contractors for the purpose of any product recall, technical campaign and/or technical consultation;

to the vehicle manufacturer(s), its/their related corporations and contractors for the purpose of market research and product planning;

to our business partners for the purpose of carrying out product promotions;

to our stakeholders and the vehicle manufacturer(s) and its/their related corporations and contractors for the purpose of carrying out surveys and audits and ensuring compliance with international service processes;

to the vehicle manufacturer(s), its/their related corporations and contractors for the purposes of obtaining assurance from the vehicle manufacturer(s) on the quality of products and services and for the development of new products and services;

to the vehicle manufacturer(s), its/their related corporations and contractors in order to facilitate orders for the vehicle(s);

to our stakeholders and the vehicle manufacturer(s) for the assessment of our performance as a dealer;

to our service providers and/or the vehicle manufacturer(s), its/their related corporations and contractors for the purposes of ensuring uniform service processes and preventing excessive customer contact;

to our service providers (including call centres) and/or the vehicle manufacturer(s), its/their related corporations and contractors for the purposes of providing comprehensive customer care and customer support via various channels (including responding to any of your queries); and

to our service providers, business partners, the vehicle manufacturer(s) and/or any other third party, its/their related corporations and contractors for the administration, performance and enforcement of any agreements and/or contracts that you have entered into with us, and/or to perform obligations in the course of or in connection with the provision of goods and/or services to you.

Clauses 1.2 and 1.3 may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

We will retain your personal information for the period of our business relationship, or for as long as it is necessary to fulfil the purpose for which it was collected, or for the retention periods as required or permitted by any contractual arrangements or under any applicable law, whichever is the latest.

The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop using and/or disclosing your personal data for any or all of the purposes listed in Clauses 1.2 and 1.3 by submitting your request in writing. Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. Please note that withdrawal of consent does not affect any collection, use and/or disclosure of your personal data prior to us completing the processing of your withdrawal request. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing. Please note that withdrawal of consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

If we change our data protection policy, we will inform you of the same by e-mailing you and/or placing notices on our web site and/or otherwise in writing, so that you may be aware of the information we collect and how we use it at all times. Continued use of our services will signify that you agree to any such changes.

Subject to clause 1.10, you have a right to request a copy of the personal data we hold about you and information about the ways in which your personal data is used or disclosed during the past year. If you wish to exercise this right, please:-

set out your request in writing and indicate whether you would like to have a copy of your personal data or you wish to have information about the ways in which your personal data is used or disclosed during the past year or both;

include proof of your identity and address (e.g. a copy of your driving licence and a recent credit card bill); and

specify the personal data you want access to, including any account or reference numbers where applicable.

We will reply to you as soon as reasonably possible upon our receipt of your aforesaid request. You shall pay an amount to access your personal data in the manner stated in this clause 1.8.

Subject to clause 1.10, you have the right to correct any inaccuracies in your data free of charge. If you wish to exercise this right, please:

set out your request in writing;

provide us with enough information to identify you (e.g. your account number, username, registration details); and

specify the information that is incorrect and what it should be replaced with.

Your access or correction requests in clauses 1.8 and 1.9 will not be granted as of right; our ability to accede to your access or correction requests is subject to the prohibitions and exceptions set out or which may be set out in the Singapore Personal Data Protection Act 2012 and its accompanying regulations.

You have the right to ask us to stop processing your personal data for direct marketing purposes. If you wish to exercise this right, please:

set out your request in writing by way of an email sent to us;

provide us with your name, NRIC number, mobile number, email and vehicle registration number to identify you;

specify the channel you are withdrawing your consent to if your objection is not to direct marketing in general, but to direct marketing by a particular channel (e.g. voice call, SMS, messaging applications (including WhatsApp and Telegram), fax, mailers or email).
